1. General

These Terms and Conditions (hereinafter referred to as “T&Cs”) of Golf Tech Golfartikelvertriebs GmbH (hereinafter also referred to as “GT”) apply to the purchase of goods made by customers via the GT online shop on the website http://scoreindustries.com. The application of the customer’s general terms and conditions is expressly excluded.

We strive to provide accurate, complete, and up-to-date information on our website. However, errors and inaccuracies cannot be ruled out. All information is provided without warranty. All rights, errors, and changes are reserved.

2. Conclusion of Contract

2.1 The customer’s order constitutes an offer to GT to conclude a contract. The receipt of the order will be confirmed promptly by GT. This confirmation does not constitute acceptance of the contract but serves as an acknowledgment for the customer. The contract is only concluded when GT accepts the order or executes the delivery. GT is not obligated to accept incoming orders. If GT declines an order, the customer will be notified in writing (e.g., via email) without the need to provide a reason.

2.2 GT will provide the customer with a confirmation of the concluded contract, including all pre-contractual information pursuant to § 4 FAGG, on a durable medium (e.g., paper or email) within a reasonable period after the contract is concluded, and no later than with the delivery of the goods.

2.3 The contract can be concluded in German or English.

3. Scope of Services and Product Information

The online shop offers golf equipment and accessories. The full range of goods available for purchase, including their essential characteristics and the total price (including all shipping and ancillary costs), is displayed in the online shop at http://scoreindustries.com.

4. Prices

4.1 All prices are gross amounts in euros, including all taxes, duties, and packaging costs. If additional shipping costs apply (see Section 4.2), they will be displayed separately before the purchase agreement is finalized.

5. Packaging

Packaging is provided by GT at its expense and in a commercially standard manner to prevent damage during transport under normal conditions. Packaging will not be taken back.

6. Delivery and Shipping

6.1 Delivery of goods to the customer occurs after GT receives payment.

6.2 The place of fulfillment for the delivery is the respective shipping location.

6.3 Shipping is only available to customers with a residence or office within Europe. Delivery to European islands is not possible.

6.4 Parcel-capable items are delivered via DPD.

6.5 Delivery is generally made within the timeframe specified online to the customer but no later than 30 days after the conclusion of the contract. The customer may withdraw from the contract due to delays only after this 30-day period has expired.

6.6 If a product is permanently unavailable, GT reserves the right to withdraw from the contract.

6.7 GT reserves the right to make partial deliveries if reasonable for the customer and necessary for a prompt process.

7. Payment Terms

7.1 Payment can be made via credit card, PayPal, or instant transfer. The customer must ensure sufficient funds in the chosen payment method.

7.2 The purchase price is due immediately upon placing the order.

7.3 The customer agrees to receive invoices electronically.

7.4 In case of payment default, the customer is liable for bank fees, statutory default interest, and costs for collection or recovery if necessary for pursuing the claim.

7.5 Customers cannot offset claims against GT unless the counterclaims are legally recognized, directly related, or acknowledged by GT.

7.6 Any bank or transfer fees, as well as potential roaming charges, are to be borne by the customer.

8. Customer Obligations

8.1 Customers must promptly check delivered goods for visible transport damage and report this to the courier upon receipt.

8.2 Customers confirm the accuracy, completeness, and currency of the information provided during the order process. Any errors in payment information must be corrected immediately by the customer.

9. Right of Withdrawal for Consumer Transactions

9.1 Consumers (as defined in § 1 Abs 1 Z 2 KSchG) have the right to withdraw from the contract within fourteen days without providing a reason.

9.2 The withdrawal period begins on the day the consumer or a designated third party (other than the carrier) takes possession of the goods. For contracts involving multiple deliveries, the period begins with the final delivery.

9.3 To exercise the right of withdrawal, customers must notify GT (Golf Tech Golfartikelvertriebs GmbH, Carlbergergasse 66, A-1230 Vienna) via a clear declaration (e.g., letter, fax, or email). Customers may use the provided withdrawal form (Appendix A), though it is not mandatory.

9.4 Exceptions: Goods made to customer specifications or tailored to personal needs are excluded from this right.

9.5 Consequences of Withdrawal: GT will refund payments, including delivery costs (except additional costs from non-standard shipping methods), within 14 days of receiving notice of withdrawal. Refunds may be withheld until the goods are returned or proof of return is provided.
