Right of Withdrawal for Consumer Transactions
1. Right of Withdrawal
If the customer is a consumer as defined in Section 1(1)(2) of the Austrian Consumer Protection Act (KSchG), they have the right to withdraw from the contract within fourteen days without providing a reason.
2. Withdrawal Period
The withdrawal period is fourteen days starting from the day the customer or a third party designated by them (other than the carrier) takes possession of the goods. For purchase agreements involving the delivery of goods in multiple consignments or pieces, the fourteen-day withdrawal period begins on the day the customer or their designated third party (not the carrier) takes possession of the last consignment or piece.
3. Exercising the Right of Withdrawal
To exercise the right of withdrawal, the customer must inform GT (Golf Tech GolfartikelvertriebsGmbH, Carlbergergasse 66, A-1230 Vienna, Austria) of their decision to withdraw from the contract through a clear declaration (e.g., a letter sent by post, fax, or email). Customers may use the sample withdrawal form provided (Appendix A), though its use is not mandatory.
To meet the withdrawal deadline, it is sufficient for the customer to send the notification of the exercise of the right of withdrawal before the withdrawal period expires.
4. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to goods that are manufactured according to the customer’s specifications or clearly tailored to their personal needs (Section 18(1)(3) FAGG).
5. Consequences of Withdrawal
If the customer withdraws from this contract, GT will reimburse all payments received from the customer, including delivery costs (except for additional costs arising if the customer chooses a delivery method other than the least expensive standard delivery offered by GT) without undue delay and no later than fourteen days from the day GT receives notification of the withdrawal.
The same payment method used in the original transaction will be used for the refund, unless expressly agreed otherwise with the customer. No fees will be charged to the customer for the refund. GT may withhold the reimbursement until they have received the goods back or until the customer has provided proof of returning the goods, whichever occurs first.
The customer must return or hand over the goods to Golf Tech GolfartikelvertriebsGmbH, Carlbergergasse 66, A-1230 Vienna, Austria without undue delay and in any case no later than fourteen days from the day they notify GT of the withdrawal. The deadline is met if the customer sends the goods before the fourteen-day period expires.
The customer is only responsible for any diminished value of the goods if this loss in value results from handling the goods in a way that is not necessary to check their nature, characteristics, and functionality.
